Terms & Conditions
Version of 5 September 2026. These Terms govern the sale of digital educational content through medsmith.pl.
1. Who you are contracting with
The seller of the content offered on this website is MEDSMITH spółka z ograniczoną odpowiedzialnością (a limited liability company under Polish law), with its registered office at ul. Janusza Wojsławica 3, 85-796 Bydgoszcz, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) kept by the Sąd Rejonowy w Bydgoszczy, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego, under number KRS 0000929692; tax identification number NIP 5542998078; statistical number REGON 520303198; share capital 5 000,00 zł. Contact: training@medsmith.pl. In these Terms we are “MEDSMITH”, “we” or “us”.
Payments are processed by our payment service provider, which acts as merchant of record for the transaction: it collects the payment, calculates and remits the applicable VAT or sales tax for your location and issues the payment receipt. Your contract for the content itself — its scope, quality and delivery — is with MEDSMITH.
2. What is sold
We sell digital educational content for professionals in pathology and related fields: recorded lecture series accessed by streaming, written course material delivered as downloadable files, and downloadable image atlases and reference sheets (together, the “Content”). Each module's page states its format, extent and access period. The Content is educational; it is not medical advice and does not replace clinical judgement or local guidelines.
No live sessions, physical goods or services involving personal instruction are sold through this website.
3. Ordering and conclusion of the contract
- You add modules to the cart, enter your details on our checkout page and are redirected to the payment provider's secure page to enter your payment method.
- The contract is concluded when the payment provider confirms the payment. You are then shown your personal order page, whose address is permanent and serves as confirmation of the order.
- Prices are shown in euro and include VAT. The payment page may present the amount in your local currency; any currency conversion is performed by the payment provider on the terms shown there.
- We may refuse or cancel an order in the event of an obvious pricing error, suspected fraud or an unavailable module; any amount already paid is refunded in full.
4. Delivery of access
Access details for streamed Content and download links for written Content are sent to the email address given at checkout within 24 hours of payment on working days (Monday to Friday, excluding Polish public holidays). Streamed access lasts for the period stated on the module page, counted from the day access is granted; downloadable material may be kept permanently. Each purchased seat is for one named person.
5. Right of withdrawal (consumers)
If you buy as a consumer (or as a sole trader for a purpose not related to your professional activity, where Polish law extends consumer protection), you have the right to withdraw from the contract within 14 days without giving a reason, subject to the following. By ticking the consent box at checkout you expressly request that we begin delivering the digital Content before the end of the withdrawal period and acknowledge that once access has been delivered you lose the right of withdrawal (art. 38(1)(13) of the Polish Consumer Rights Act, implementing Directive 2011/83/EU). Until access is delivered, you may withdraw by email and receive a full refund within 14 days. The access & withdrawal policy describes the procedure and contains a model form.
6. Licence and permitted use
The Content is protected by copyright. Purchase grants a personal, non-exclusive, non-transferable licence to view the streamed Content and to store and use the downloadable Content for your own professional education. You may not copy, record, share, resell or publicly present the Content, share access details, or remove notices of authorship. Institutional licences for several participants are sold as multiple seats; each seat is personal.
7. Conformity, complaints and liability
The Content must conform to its description. If it does not — for example a file does not open or a lecture is missing — write to training@medsmith.pl; we respond within 14 days and repair, replace or refund as appropriate under the Consumer Rights Act. Our liability towards business customers is limited to the price paid for the module concerned, except for damage caused intentionally. Nothing in these Terms limits rights that cannot be limited by law.
8. Personal data
We process your data as described in the Privacy notice. Billing details are collected on our checkout page and passed to the payment provider so that the payment can be processed and the correct tax applied.
9. Dispute resolution
Polish law applies, without prejudice to mandatory consumer protection rules of your country of residence. Consumers may use the EU online dispute resolution platform (ec.europa.eu/consumers/odr) or the Polish out-of-court bodies listed by the Office of Competition and Consumer Protection (UOKiK). Disputes with business customers are settled by the court competent for our registered office.
10. Changes
We may amend these Terms for future orders. The version in force at the time of your order applies to that order.
